Terms of Use.

By using Voxling App (the App), you agree to our terms & conditions of service.

By registering and opening an account on Voxling App, you (the user) are indicating that you have read and fully understands all the terms and policy stated herein this document.  By using the App you agree to the following Terms and Conditions.

By using Voxling, you agree to refer to and comply with all applicable state and federal laws and regulations including, but not limited to Do-Not-Call Implementation Act of 2003 and Do-Not-Call Improvement Act of 2007 as well as any other applicable state and Federal laws.

Although Voxling's communication service is built to be reliable and scalable, it is possible that we may experience service outage and not be able to provide our services on any given day.

If for any reason we do experience an outage of our services, it goes without saying that call credits will not be charged for undelivered messages.  However, Voxling will have no obligation or liability for any inconvenience or damage our service outage may cause beyond refund of credit.

We reserve the right to change, limit, or eliminate terms of service at anytime without advance notice. If such a change is made to Voxling, we will notify the changes through this website.

Once you have submitted a call to our system through Voxling App, it is not practically possible to stop the delivery if you have the necessary call credit in your account.  So, please be careful and double check your settings and message before you submit your request.  Also note that when you schedule a call to be sent at a specific time, the call will be sent out at that time to ALL your callers at your local scheduled time and is not adjusted for each phone number's local time zone.

Voxling uses Apple Inc.'s App Pay service to process your payment, as such all refund requests must go through the Apple Inc.'s payment service and approved by Voxling.  Apple's payment service takes 30% fee on all your payments before it passes on the proceeds to Voxling.  As such, we will not be able to refund Apple's payment processing fee if Apple decides not to refund the fees it charged for any reason.

All accounts can and will be terminated at our discretion if we find our service is being abused or used in a manner in which Voxling finds offensive, inappropriate, or illegal. If this occurs you may be blocked from using our system in the future. You may contact Voxling regarding any abuse issues and we will evaluate them on a case by case basis.

You agree that you will not use the calling and/or texting (SMS) services to send any unsolicited messages, commercial solicitations or advertisements for the sale of goods or services or spam. To use our calling services you agree to fully comply with the Federal Do Not Call guidelines which can be found at www.DoNotCall.gov, the Telemarketing Sales Rule and the Telephone Consumer Protection Act.  You are responsible for knowing and implementing the restrictions found in these rules.  You agree that it is solely your responsibility to update and maintain your call list and check and make sure that you have the legal clearance to contact people on the list by phone.

Our system had been tested to work with most of answering machine and voicemail systems available on the market. However, it is not possible to guarantee that we can maintain 100% compatibility with all systems. Voxling will NOT refund credits for messages that were not successfully left on the recipient's voicemail or answering machine as long as the phone call was connected.  This means that even if some parts of voice message was not recorded by the answering machine or voice mail system, you will still  be charged for the connected call.

You are responsible for all the content being sent to your contacts, via both our voice and text messaging features, and will be fully responsible if any legal issues or disputes arise from your use of Voxling. We will fully cooperate with state and federal law enforcement and will provide them any information that's requested legally. This information includes, but is not limited to, phone numbers, e-mail addresses, IP logs, and any other information that the authorities may request.

Regarding our text messaging services, we will not charge for text messages mistakenly sent to phone numbers that are determined as non-mobile (cell phone) numbers.  Otherwise, once calls are sent, our system will still charge for text messages that fail, do not connect, or are otherwise not successful delivered. Due to the nature of text messaging and SMS services, we charge once we hand over the text message to destination carrier, but cannot be responsible if texts end up never reaching their target destination for whatever reason.  Because our service is still charged for undelivered texts by the carriers, we're obliged to pass the charge on to the user.

By sending and receiving text messages, emails, and other communications using Voxling App, you agree that Voxling, its employees, affiliates, and associates are not responsible for the cost of making the communications as may be charged to you by your cellular telephone carrier, internet service provider, and the like. Voxling, its employees, affiliates, and associates are not liable for any costs or damages arising directly or indirectly from problems with our service. Voxling will have no liability whatsoever with this agreement and our services.

The App may allow the user to record the calls it makes to contacts, you agree that you will comply with all federal, state, and local laws and regulations with regards to the permissibility of recording the calls.  We recommend that you disclose that the call may be recorded by changing the prompt setting or including the disclosure as part of your voice message.
